1. Scope and Contracting Parties

These Terms and Conditions (hereinafter “T&Cs”) apply to all contracts between FlirtBirds (hereinafter “Provider” or “we”) and users (hereinafter “User” or “you”) regarding participation in events and use of the website.

2. Subject Matter and Services

2.1 Events

FlirtBirds organises and hosts events for singles to facilitate in-person connections. Specific details of each event (date, location, number of participants, price) are announced in the respective event description.

Users may subscribe to the free newsletter service to receive information about upcoming events and news.

3. Formation of Contract

3.1 Event Bookings

A contract for participation in an event is formed as follows:

The user submits a binding offer to participate by selecting an event and entering their details.
Upon receipt of the booking, the user receives an automatic acknowledgement of receipt by email.
Acceptance of the offer is made by a separate booking confirmation email within 48 hours.

Newsletter registration is completed by entering an email address and confirming via a double opt-in link sent by email.

4. Prices and Payment Terms

4.1 Prices

All prices stated are final prices inclusive of the applicable statutory VAT. Prices apply at the time of booking.

4.2 Early Bird Discounts

Early bird participants receive a 20% discount on the regular event price. The early bird allocation is limited and operates on a first-come, first-served basis.

4.3 Payment Methods

Payment may be made by:

Credit card
PayPal
Bank transfer (advance payment)

4.4 Due Date

The full participation fee is due at the time of booking unless otherwise agreed.

5. Participation Requirements

5.1 Minimum Age

Participation in FlirtBirds events is only permitted for persons who have reached the age of 18.

5.2 Eligibility

The user confirms that they:

are single or have their partner’s permission to participate
provide accurate information
behave respectfully towards other participants
acknowledge and comply with the Code of Conduct

5.3 Exclusion

The Provider reserves the right to exclude participants who violate these T&Cs or the Code of Conduct.

6. Right of Withdrawal

6.1 Withdrawal Notice

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date the contract is concluded.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email).

6.2 Consequences of Withdrawal

If you withdraw from this contract, we will repay all payments received from you promptly and no later than fourteen days from the date on which we receive notification of your withdrawal.

6.3 Exclusion of the Right of Withdrawal

The right of withdrawal expires for contracts for the provision of services once the provider has fully performed the service, provided the consumer has expressly agreed to performance beginning before the withdrawal period has expired and has acknowledged that the right of withdrawal is lost upon full performance of the contract by the provider.

7. Cancellation and Rebooking

7.1 Cancellation by the User

Up to 14 days before the event: Free cancellation, full refund
7–13 days before the event: 50% of the participation fee is refunded
Less than 7 days before the event: No refund

7.2 Rebooking

One free rebooking to a different event is possible up to 7 days before the originally booked event, subject to availability.

7.3 Cancellation by the Provider

The Provider reserves the right to cancel events if the minimum number of participants is not reached or for other important reasons. In such cases, the full participation fee will be refunded. Further claims are excluded.

8. Liability

8.1 Limitation of Liability

The Provider is liable without limitation:

for intent and gross negligence
for injury to life, body, or health
under the provisions of product liability law

For minor negligent breaches of material contractual obligations, liability is limited in amount to the foreseeable typical damage at the time the contract was concluded. All other liability is excluded.

8.2 Liability for Conduct

The Provider is not liable for the conduct of participants towards one another. Each participant is solely responsible for their own behaviour.

9. Data Protection

The collection and use of personal data is governed by our Privacy Policy, which can be viewed at [link to privacy policy].

10. Photography and Image Rights

10.1 Event Photography

Photos may be taken at events for documentation and marketing purposes. Participants who do not wish to be photographed may inform the team on site.

10.2 Use of Images

By registering, participants agree that photos in which they appear may be used for marketing and promotional purposes. This consent may be withdrawn at any time.

11. Code of Conduct

By making a booking, the user acknowledges the FlirtBirds Code of Conduct, which can be viewed at [link to Code of Conduct].

12. Changes to the T&Cs

We reserve the right to amend these T&Cs at any time. Users will be notified of changes by email. If the user does not object to the amended T&Cs within two weeks of receiving the notification, the amended T&Cs are deemed accepted.

13. Final Provisions

13.1 Applicable Law

Swiss law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

13.2 Place of Jurisdiction

To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the Provider.

13.3 Severability Clause

If any provision of these T&Cs is or becomes invalid, the validity of the remaining provisions shall not be affected.
